1.1. These terms and conditions (together with the other documents referred to in them) tell you the terms and conditions on which you may make use of our website and web application ONREQUEST www.onrequest.org, whether as a guest (that is, a user who is not a registered user of Onrequest) or as a registered user.
1.2. Please read these terms and conditions carefully before you start to use Onrequest. We recommend that you print a copy of them for future reference.
2. Accessing Onrequest
2.1. Onrequest is intended for personal or business use.
2.2. You may not use Onrequest if you are under the age of 14. If you are over the age of 14 but under the age of majority in the place from which you access Onrequest, you confirm that you are using Onrequest with the permission of your parent or guardian, and that such parent or guardian will be responsible to us for ensuring that you comply with these terms and conditions.
2.3. To the extent that your use of Onrequest is on behalf of a company or other operating entity, by using Onrequest you confirm that you are authorised to act on behalf of such company or other entity in that regard.
2.4. Access to certain content on Onrequest is made available free of charge to guests and registered users (the Guest Services). By using Onrequest as a guest you confirm that you accept these terms and conditions and that you agree to comply with them. If you do not agree to these terms and conditions, you must not use Onrequest.
2.5. If you become a registered user of Onrequest in addition to the Guest Services:
2.5.1. you will receive access free of charge to additional content and functionality (the Member Services) subject to these terms and conditions; and
2.5.2. in return for the payment of the applicable charges by you, certain further functionality will be available to you (the Subscriber Services) subject to these terms and conditions.
2.6. The terms and conditions applying to the Guest Services, the Member Services and the Subscriber Services are set out below.

4. Information about us
www.onrequest.org is a site operated by Onrequest Ltd. We are a limited company registered in England and Wales under company number 07270964 whose registered office is c/o Accountant, Field Cottage, Bodiam, Robertsbridge, East Sussex, TN32 5UY and whose business address is at Brighton Media Centre, 15-17 Middle Street, Brighton, East Sussex BN1 1AL, United Kingdom.
5. Changes to these terms and conditions
5.1. If you are using Onrequest as a guest, we may revise these terms and conditions at any time by amending this page. Please check this page from time to time to take notice of any changes we make, as they are binding on you. Some of the provisions contained in these terms and conditions may also be superseded by provisions or notices published elsewhere on Onrequest where these specify that they override or supersede these terms.
5.2. If you are using Onrequest as a registered user then you will be asked to read and accept these terms and conditions at the time you register with us to become a registered user. We may revise these terms and conditions at any time and in the event of such a revision, you may be asked to read and accept the revised terms and conditions at the time you log in to Onrequest as a registered user.
5.3. No variation to these terms and conditions may be made save by a variation notified by us on Onrequest as described above, or else in writing signed by you and us.
6. Becoming a registered user
6.1. If you wish to become a registered user of Onrequest, you must complete all of the required fields on the registration page. In order to have access to the Subscriber Services, you must pay the applicable fees set out on the relevant page of our website.
6.2. You may not use Onrequest if you are under the age of 14. If you are over the age of 14 but are not over the age of majority in the place from which you access Onrequest, you must have permission from your parent or guardian in order to register, in which case:
6.2.1. any contract formed with us under clause 6.5 below, is between us and your parent or guardian; and
6.2.2. any registration with and use of Onrequest by you is by you acting on behalf of your parent or guardian, who is responsible to us for ensuring that you comply with these terms and conditions.
6.3. Except as set out in clause 6.2, by becoming a registered user of Onrequest, you confirm you are over the age of majority in the place from which you access Onrequest.
6.4. Your registration with Onrequest will be on-going unless terminated in accordance with these terms and conditions.
6.5. We will confirm our acceptance of your registration by sending you an email to that effect. The contract between us will only be formed when we send this confirmation to you.
6.6. If we are unable to accept your registration request, we will inform you of this by email.
6.7. Only one account per registered user is permitted at any one time. Fake profiles are not permitted.
6.8. We reserve the right to deactivate any accounts which (i) have not been purchased by the bank account holder; or (ii) have not been used for six months or more.
7. Your account and password
7.1. If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.
7.2. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time if, in our reasonable opinion, you have failed to comply with any of the provisions of these terms and conditions.
7.3. Your account is for your own use only. You may not authorise others to use your account, and you may not assign or otherwise transfer your account to any other person or entity. If you know or suspect that anyone other than you knows or has obtained your user identification code or password and/or has accessed your account, you must immediately notify us at firstname.lastname@example.org or via our contact page and change your password.
7.4. You are responsible for the acts and omissions of any third parties who use your user identification code or password to access your account, whether fraudulent or not, and you agree to reimburse us on demand for any loss we may suffer as a result of such use.
8. The Guest Services, the Member Services and the Subscriber Services
8.1. As part of the Guest Services you may access certain limited content and functionality on Onrequest. The content available under the Guest Services will be determined by us from time to time, and may include the ability to browse and view ideas created by registered users.
8.2. The Member Services may include, in addition to the Guest Services, any or all of the following additional functionality or content:
8.2.1. the ability to create a profile on Onrequest;
8.2.2. the ability to create and display ideas on Onrequest;
8.2.3. the ability to share your ideas with other users of Onrequest or your own outside contacts; and
8.2.4. the ability to interact with ideas created by other registered users
8.3. Subject to payment of the applicable fees, the Subscriber Services may include, in addition to the Guest Services and the Member Services, any or all of the following additional functionality or content:
8.3.1. the ability to link goods and services to your profile;
8.3.2. the ability to link goods or services to specific ideas (whether your own or other users”™);
8.3.3. the ability to message other registered users including subscribers;
8.3.4. the ability to access the Subscriber area of Onrequest, in which you will be able to connect directly with other Subscribers; and
8.3.5. receiving notifications regarding specific opportunities which may be presented in relation to ideas submitted to Onrequest.
8.4. We may update Onrequest from time to time, and may change the content and/or services we provide on it at any time. However, please note that, although we make reasonable efforts to update the content we provide on Onrequest, we make no representations, warranties or guarantees, whether express or implied, that such content is accurate, complete or up-to-date and we are under no obligation to update it.
8.5. We do not guarantee that Onrequest, or any content on it, will always be available or be uninterrupted. Access to Onrequest is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of Onrequest without notice. We will not be liable to you if, for any reason, Onrequest is unavailable at any time or for any period.
8.6. You are responsible for making all arrangements necessary for you to have access to Onrequest.
8.7. You are also responsible for ensuring that all persons who access Onrequest through your internet connection are aware of these terms and conditions and other applicable terms and conditions, and that they comply with them.
8.8. Onrequest is intended for use worldwide. Wherever you access and use Onrequest from, you agree that you will only use Onrequest in a manner consistent with these terms and conditions and any and all applicable local, national and international laws and regulations. To the extent that your use of Onrequest is not legal in your jurisdiction, you may not use Onrequest.
9. Responsibility for Member Content
9.1. All information, text or other materials that registered users submit to Onrequest, including all materials accessible by links embedded within content submitted to Onrequest (the Member Content) is the sole responsibility of the registered user submitting such Member Content. We may not monitor or control the Member Content uploaded, downloaded or posted to Onrequest and we cannot take responsibility for it. In particular, you are responsible for applying the appropriate privacy settings to Member Content submitted by you.
9.2. Whenever you submit Member Content to Onrequest, you acknowledge that you do so entirely at your own risk and that you must comply with these terms and conditions, in particular the content standards set out at clause 15 below. You warrant that any such Member Content complies with these terms and conditions, and you will be liable to us for and indemnify us for any breach of that warranty. This means that you will be required to reimburse us on demand for an amount equal to any damages, loss, expenses or costs (including legal costs) suffered or incurred by, or claimed from, us as a result of your breach of warranty.
9.3. You may designate Member Content as being private (that is, visible only to you), available only to specified registered users, or freely available by guests and all registered users. You acknowledge that it is solely your responsibility to apply these designations to all appropriate Member Content and that you are entirely responsible for the consequences of doing so, or failing to do so.
9.4. We have the right to disclose your identity to any third party who is claiming that any Member Content posted by you to Onrequest constitutes a violation of their intellectual property rights or of their right to privacy.
9.5. We reserve the right to monitor the Member Content you submit to Onrequest and to remove any such Member Content if, in our sole opinion, it does not comply with these terms and conditions or any applicable law or upon the reasonable request of any third party.
9.6. If your registration with Onrequest is terminated, we have the right to delete any Member Content that you have submitted to Onrequest, although such Member Content (other than your profile) may still appear on Onrequest following such termination.
10. Reliance on Member Content submitted by other registered users and interaction with other registered users
10.1. You acknowledge that any use or reliance by you on any Member Content (as defined in clause 9.1 above) submitted by other registered users is entirely at your own risk. In particular, you acknowledge that to the extent that you decide to act on any Member Content in any way, including by responding to a request for assistance or for goods or services made by another registered user; or by offering goods, services or assistance to other registered users; or by otherwise interacting or engaging with other registered users through Onrequest, we take no responsibility for the consequences of such actions and in particular no guarantee is made by us that such actions will benefit you or your business in any way. All decisions and actions taken by you in connection with you or your business or otherwise are your responsibility and at your own risk.
10.2. We do not endorse, support, represent or guarantee the completeness, truthfulness, accuracy, or reliability of any Member Content or endorse any opinions expressed by registered users via Onrequest. You understand that, by using Onrequest, you may be exposed to Member Content that might be inaccurate, inappropriate, or otherwise deceptive. Under no circumstances will we be liable in any way for any Member Content, including, but not limited to, any errors or omissions in any Member Content, or any loss or damage of any kind incurred as a result of the use of any Member Content made available via Onrequest.
11. Intellectual property rights
Intellectual property rights in Member Content
11.1. You are solely responsible for all issues regarding the intellectual property rights in relation to Member Content (as defined in clause 9.1 above) submitted by you and we take no responsibility whatsoever in this regard. In particular you are responsible for:
11.1.1. ensuring that Member Content submitted by you does not infringe the intellectual property rights of third parties; and
11.1.2. ensuring that any intellectual property rights subsisting in, derivable from or otherwise relating to Member Content submitted by you, is adequately protected and that your submission of Member Content to Onrequest, or your interaction with other registered users on Onrequest, will not prejudice such protection. You acknowledge that you may not be able to prevent other registered users or guests from using the concepts or ideas presented in Member Content submitted by you.
11.2. You (or your licensors) retain any intellectual property and other rights to any Member Content you submit to Onrequest. By submitting Member Content to Onrequest, you represent and warrant to us that you have the right to submit such Member Content and you grant us a perpetual, worldwide, non-exclusive, royalty-free licence (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such Member Content in any and all media or distribution methods.
11.3. Whilst you will retain ownership of the copyright in the Member Content submitted by you, you agree that Member Content may become part of a database and that we will own the compilation copyright in that database.
Intellectual property rights in Onrequest
11.4. Except for Member Content, we are the owner or the licensee of all intellectual property rights in Onrequest and in the material published on it. All such rights are reserved.
11.5. You may print off one copy, and may download extracts, of any page(s) from Onrequest for your use of Onrequest in accordance with these terms and conditions.
11.6. You must not modify the paper or digital copies of any materials you have printed off or downloaded from Onrequest in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text (unless the same are owned by you).
11.7. Our status (and that of any identified contributors) as the authors of the content provided by us on Onrequest must always be acknowledged.
11.8. You must not use any part of the content on Onrequest for commercial purposes without obtaining a licence to do so from us or our licensors.
11.9. If you print off, copy or download any part of Onrequest in breach of these terms and conditions, your right to use Onrequest will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
12. Limitation of our liability – THE USER”™S ATTENTION IS PARTICULARLY DRAWN TO THIS CLAUSE
12.1. Nothing in these terms and conditions excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.
12.2. In relation to the Guest Services, the Member Services and the Subscriber Services:
12.2.1. to the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to Onrequest or to any content on it, whether express or implied; and
12.2.2. we will not be liable to any user for any loss or damage whatsoever, whether in contract, tort (including negligence), breach of statutory duty or otherwise, even if foreseeable, arising out or in connection with use of, or inability to use, Onrequest including your use of, or reliance on, any content displayed on Onrequest and any use of the Guest Services, the Member Services and/or the Subscriber Services. In particular (but without limiting the previous exclusion), we will not be liable for the following:

18.104.22.168. loss of business opportunity, goodwill or reputation;

12.3. The terms implied by sections 3 to 5 of the Supply of Goods and Services Act 1982 are, to the fullest extent permitted by law, excluded from this agreement.
12.4. We will also not be liable to you for any loss or damage to your reputation, or other consequences resulting from your dissemination or revelation of information concerning you. It is your responsibility to decide what information you wish to make available about yourself and your ideas through Onrequest and we cannot be held liable for any misuse of that information or ideas by any other user of Onrequest.
12.5. We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of Onrequest or your downloading of any content on it, or on any website linked to it.
12.6. Subject to clauses 12.1 to 12.5, our total liability to any user (whether as a guest or a registered user), whether in contract, tort (including negligence), for breach of statutory duty, or otherwise, arising under or in connection with these terms and conditions shall be limited to the greater of:
12.6.1. £50 per claim; and
12.6.2. in respect of all claims (connected or unconnected) in any given six month period, the equivalent of the total sums paid (if any) by the user to us in that period.
13. Prohibited uses of Onrequest
13.1. You may use Onrequest only for lawful purposes. You may not use Onrequest:
13.1.1. in any way that breaches any applicable local, national or international law or regulation;
13.1.2. in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
13.1.3. to send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards as set out below;
13.1.4. to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam); or
13.1.5. to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
13.2. You also agree:
13.2.1. not to reproduce, duplicate, copy or re-sell any part of Onrequest in contravention of these terms and conditions;
13.2.2. not to impersonate any other registered users; and
13.2.3. not to access without authority, penetrate, interfere with, damage or disrupt (or attempt to do any of the same): (i) the accounts of other registered users; (ii) any part of Onrequest or its security measures; (iii) any equipment or network on which Onrequest is stored; (iv) any software used in the provision of Onrequest; or (v) any equipment or network or software owned or used by any third party.
14. Interactive services
14.1. We may from time to time provide interactive services on Onrequest, including, without limitation, access to the Subscriber area of Onrequest, bulletin boards, messaging services and any others.
14.2. Where we do provide any interactive service, we will provide clear information to you about the kind of service offered, if it is moderated and what form of moderation is used (including whether it is human or technical).
14.3. We will do our best to assess any possible risks for users from third parties when they use any interactive service provided on Onrequest, and we will decide in each case whether it is appropriate to use moderation of the relevant service (including what kind of moderation to use) in light of those risks. However, we are under no obligation to oversee, monitor or moderate any interactive service we provide on Onrequest, and we expressly exclude our liability for any loss or damage arising from the use of any interactive service by a user in contravention of our content standards, whether the service is moderated or not.
14.4. Where we do moderate an interactive service, we will normally provide you with a means of contacting the moderator, should a concern or difficulty arise.
15. Content standards
15.1. These content standards apply to any and all Member Content (as defined in clause 9.1 above) which you submit to Onrequest, and to any interactive services associated with it.
15.2. You must comply with the spirit of the following standards, as well as the letter. The standards apply to each part of any Member Content as well as to its whole.
15.3. Onrequest is a platform for you to share your ideas with the world and to develop those ideas and explore others”™ ideas, including connecting with other registered users who might be able to help you, or vice versa.
15.4. Contributions must:
15.4.1. be accurate (where they state facts);
15.4.2. be genuinely held (where they state opinions); and
15.4.3. comply with applicable law in the UK and in any country from which they are posted.
15.5. Contributions must not:
15.5.1. contain any material which is defamatory or inaccurate of any person;
15.5.2. contain any material which is obscene, offensive, hateful or inflammatory;
15.5.3. promote indecent or sexually explicit material;
15.5.4. promote violence;
15.5.5. promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
15.5.6. infringe any copyright, database right, trade mark or other intellectual property rights of any other person;
15.5.7. contain video, audio photographs or images of another person without his or her permission (or in the case of a minor, the minor’s legal guardian);
15.5.8. be likely to deceive any person;
15.5.9. be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence;
15.5.10. advocate, promote, assist or enable any illegal or unlawful activities (including, without limitation, copyright infringement or computer misuse) or intend to defraud, swindle or deceive other users of Onrequest;
15.5.11. be threatening, abuse or invade another’s privacy or cause annoyance, inconvenience or needless anxiety;
15.5.12. be likely to harass, upset, embarrass, alarm or annoy any other person;
15.5.13. be used to impersonate any person or to misrepresent your identity or affiliation with any person;
15.5.14. give the impression that they emanate from us, if this is not the case; or
15.5.15. disseminate or otherwise disclose another person’s personal information without his or her prior permission, or collect or solicit another person’s personal information for commercial or unlawful purposes.
16. Ending your registration
16.1. You may at any time, and without the need to provide any reason, end your registration with us by requesting the closure of your account in the area of Onrequest designated for such purposes. Your registration will end on the first working day after receipt by us of your request for closure.
16.2. We will determine, in our discretion, whether there has been a breach of these terms and conditions through your use of Onrequest and/or receipt of the Guest Services, the Member Services and/or the Subscriber Services. When such a breach has occurred, we may take such action as we deem appropriate, including all or any of the following actions:
16.2.1. immediate, temporary or permanent withdrawal of your right to use Onrequest including the suspension or cancellation of your registration;
16.2.2. immediate, temporary or permanent removal of any Member Content submitted by you to Onrequest;
16.2.3. issue of a warning to you;
16.2.4. legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;
16.2.5. further legal action against you; and
16.2.6. disclosure of such information to law enforcement authorities as we reasonably feel is necessary.
16.3. The responses described above are not limited and we may take any other action we reasonably deem appropriate.
16.4. In the event that your registration ends for any reason, we may remove any or all Member Content submitted by you during your registration.
17.1. We do not guarantee that Onrequest will be secure or free from bugs or viruses.
17.2. You are responsible for configuring your information technology, computer programmes and platform in order to access Onrequest. You should use your own virus protection software.
17.3. You must not misuse Onrequest by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to Onrequest, the server on which Onrequest is stored or any server, computer or database connected to Onrequest. You must not attack Onrequest via a denial-of-service attack or a distributed denial-of-service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use Onrequest will cease immediately.
18. Linking to Onrequest
18.1. You may link to our home page, provided that you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.
18.2. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
18.3. Onrequest must not be framed on any other site.
18.4. We reserve the right to withdraw linking permission without notice.
18.5. The website in which you are linking must comply in all respects with the content standards set out above.
18.6. If you wish to make any use of any content on Onrequest other than that set out above, please contact email@example.com or contact us via our contact page.
19. Third party links and resources in Onrequest
19.1. Where Onrequest contains links to other sites and resources provided by third parties who are not under our control, including, without limitation, advertisers, these links are provided for your information only.
19.2. We have no control over, and assume no responsibility for, the content of those sites or resources or their availability. Any such links should not be interpreted as endorsement by us of those sites and we will not be liable for any loss or damage that may arise from your use of them.
20. Applicable law
20.1. These terms and conditions, their subject matter and their formation, are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales
21. Trade marks
21.1. “Onrequest” is a trade mark of Onrequest Ltd.

INFORMATION WE MAY COLLECT FROM YOU
We may collect and process the following data about you:
Information you give us. You may give us information about you by filling in forms on our site www.onrequest.org (our site) and our app or by corresponding with us by phone, e-mail or otherwise. This includes information you provide when you submit ideas and other content to our site, and when you report a problem with our site. The information you give us may include your name, address, work address, e-mail address and phone numbers, financial and credit card information, personal description and photograph, your interests, and links to your website, blogs, and social media details.
Information we collect about you. With regard to each of your visits to our site we may automatically collect the following information:
technical information, including the Internet protocol (IP) address used to connect your computer to the Internet, your login information, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform; and
information about your visit, including the full Uniform Resource Locators (URL) clickstream to, through and from our site (including date and time); products you viewed or searched for; page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page and any phone number used to call our customer service number.
